Kevin Costner has claimed his estranged wife Christine Baumgartner is refusing to leave their home after filing for divorce.
Baumgartner, 49, was spotted at their $145m beachfront mansion in Carpinteria, California on Wednesday (14 June) as it emerged the Yellowstone actor is taking legal steps to get her out of the home.
The Oscar-winning actor, 68, cited his prenup, which reportedly states that Baumgartner must move out.

According to court documents obtained by ET, the prenup, which was signed when they got married in 2004, Baumgartner agreed that in the event of a divorce, Costner would have exclusive possession and use of his separate property residences.
She also agreed to vacate any separate property family residence she was living in within 30 days of filing of a divorce petition.
Baumgartner filed for divorce on May 1, however she has yet to move out, despite Costner’s multiple requests and offers to assist her financially in helping her relocate to a new house, he claims.

Baumgartner listed the date of separation as April 11 in her divorce filing and cited irreconcilable differences as the grounds to divorce.
According to the documents, Baumgartner has taken the position that she will not move out of her estranged husband’s separate property residence unless and until he agrees to various financial demands.
Property inspectors were spotted at the property on Wednesday, however it is currently unclear why they were there.
Costner claims in the court documents that he has already contributed to his estranged wife’s attorney and account fees and paid her $1,200,000 owed to her under the terms of their prenup and proposed a comprehensive temporary child support and fee proposal.

The couple share three children: Cayden, 16, Hayes, 14 and Grace, 13.
In the court documents, Costner claims that he is continuing to pay for all of their children’s expenses and has agreed to maintain the financial status quo.
The prenup stipulates that the Bodyguard star must pay a $200,000 for Baumgartner's new residence and cover its mortgage each month, plus property tax and insurance payment for one year.

Costner says in the court filing that he’s prepared to follow through with this stipulation.
After the handbag designer filed for divorce, a statement released by Costner’s representatives said: “It is with great sadness that circumstances beyond his control have transpired which have resulted in Mr. Costner having to participate in a dissolution of marriage action.
"We ask that his, Christine's, and their children's privacy be respected as they navigate this difficult time."
